Legal responsibility of the state as a manifestation of its value characteristics

The article examines the theoretical and legal foundations of the essence of the legal responsibility of the state as a special institution, which, subject to its proper implementation, is one of the manifestations of the value characteristic of the state. Important in this direction is the institution of legal responsibility of the state to the person, the presence and real implementation of which allows to ensure the guarantee of the rights and freedoms of man and citizen. The institute of legal responsibility is analyzed through the prism of the responsibility of its bodies and officials. In this direction, the value orientations of the state are based on the principles of universal values, follow from social responsibility and receive a manifestation in the unity of rights, obligations of both the state and society. Modern European trends that substantiate the specifics of the institute of legal responsibility are investigated. Thus, the article analyzes the main provisions put forward by the theory of «risk», which implies that the state bears strict responsibility if an official or body of the state commits an unlawful act. The questions of procedural of legal liability related to its implementation, the purpose of which is to ensure the possibility of bringing the state to legal responsibility, are also investigated. The reality of the procedures of legal responsibility of state primarily depends on the availability of justice and bodies exercising state power in other areas.
