The building industry as an object of criminal law protection

The article is devoted to the analysis of criminal law protection of the building industry as a necessary element of sustainable development of this branch of the Ukrainian economy. The relevance of this direction of research is determined, taking into account the extremely important role of the building industry in the economy. The essence of the term «object of criminal protection» in the theory of criminal law and its relationship with the related concept «object of crime» are analyzed. It was determined that these concepts are not identical, although they are closely related.

Building industry is defined as a combination of the following elements: new construction, restoration, reconstruction, and capital repair. Peculiarities of building legislation of Ukraine are analyzed. Socially significant signs of building legal relations as an object of criminal law protection have been established. The dualism of these legal relations, which contain both private law and public law components, is defined. It was established that the private-law segment of building legal relations mediates contractual relations between construction market participants, while the public-law segment of construction legal relations is aimed at ensuring general public interests, ensuring the sustainable development of settlements and rational use of land for residential, industrial and other construction.

The author’s definition of the construction industry as an object of criminal law protection is formulated, which is a set of public-law and private-law social relations regulated by the norms of building legislation with the aim of ensuring a balance between the private-law interests of construction market participants and general public interests in the field of building industry (new construction, reconstruction, restoration, capital repair of the construction object).
