Prospects for codification of municipal law in Ukraine in the context of foreign experience

 In the process of formation and modernization of local self-government, the study of the role, essence, content, main directions and forms of regulatory influence of the Constitution of Ukraine, laws and other sources of municipal law on social relations in the sphere of organization and functioning of municipal power and protection of municipal human rights is of particular importance.

The article analyses the factors which determine the emergence, formation and separation of municipal law into a separate independent branch of national law, among which a special place is occupied by the processes of formation of specialised municipal legislation. In this context, the author draws attention to the trends in the development of municipal law in the context of modern challenges and the prospects for its codification. The initiative to develop the Municipal Code of Ukraine was announced in February 2021 by the President of Ukraine V. Zelenskyy.

 The author emphasises that codification of municipal law is a complex task which requires not only enormous intellectual, material, time and political resources, but also requires streamlining and large-scale revision of the current legislation on local self-government. The article examines some conceptual issues of possible codification of Ukrainian municipal law in the context of relevant foreign experience.

The foreign experience of codifying municipal legislation at the national level shows that legislative acts in the field of local self-government with the name “code” are common in the practice of some foreign countries. In particular, the legislation on territorial collectives is codified in Burkina Faso, France, South Africa, Cameroon, Senegal, the Philippines, Georgia, etc. The article analyses the peculiarities of municipal codes of some of these countries.

The analysis of domestic and foreign experience in the formation of municipal legislation has led to the conclusion that an official initiative to codify Ukrainian municipal law is premature. It is argued that codification of the branches of law not officially recognised by the State and unstable specialised legislation on an extremely contradictory conceptual basis and public policy is inappropriate.
