The Realization of Law in the Context of Its Norms, Principles, and Standards: Broad and Narrow Approaches

Article offers a comprehensive analysis of the process of legal realization through the lens of conceptual distinctions between narrow and broad approaches to the phenomenon. The narrow approach is defined as the realization of legal norms exclusively, whereas the broad interpretation also encompasses the realization of legal principles and relevant legal standards. The author substantiates the need for a doctrinal distinction between the realization of legal norms — as legally determined, law-abiding conduct — and the broader realization of law as a complex phenomenon that includes the incorporation of fundamental legal values and principles, particularly at the international level.

The article traces the evolution of the concept of “realization of law” in the scholarship of the Kharkiv, Kyiv, and broader European legal schools. It also explores the relationship between legal realization and various forms of lawful conduct, including the exercise of rights, fulfillment of obligations, observance of prohibitions, and application of legal norms. Particular attention is paid to the role of general principles of law — especially the principle of respect for human rights — as a crucial factor in ensuring effective legal realization amid the transformation of the international legal order.

It is argued that a substantive revision of the normative effectiveness of international law can be achieved specifically through the prism of the broad approach. The study also identifies current threats to legal realization, including the politicization of law, the spread of legal nihilism, and dysfunction within international legal enforcement mechanisms. The author proposes a “reboot” of international law through value-based interpretation of legal principles and their effective realization at both the domestic and international levels. The article ultimately emphasizes the need for an in-depth analysis of the realization of legal standards as a distinct direction of contemporary legal doctrine.
