Abuse as a deformation in the process of implementing law

The article is devoted to the characterization of abuse as a deformation in the process of implementing law. Modern approaches to the definition of abuse of law are studied and it is concluded that this term should be understood as a form of negative (deformed) implementation of law contrary to its social purpose, with the aim of causing harm to other persons or obtaining benefits that contradict good faith. Abuse of law in the process of its implementation leads to the deformation of the legal consciousness of each individual who resorts to it, and the entire legal system, as it leads, for example, to the formation of corrupt schemes in various state spheres and leads to other legal deviations.

The focus is on the features of abuse of law at the present stage. In particular, the commission of actions aimed at disrupting the functioning of the judicial system; cases when the right is implemented not for the purpose of satisfying a legitimate interest, but for the sake of harm, pressure or benefit; the use of technical and legal advantages to monopolize access to legal instruments. In addition, the Internet allows you to act anonymously or under fictitious identities, which makes it difficult to identify the perpetrator of the abuse and hold them accountable.

Methods of combating abuse of law should be understood as legal means, tools and approaches used to identify, stop and prevent situations when a person formally uses his rights, but for an unlawful purpose. The following methods of combating abuse of law are given: 1) educational — these are measures aimed at increasing the level of legal culture, awareness and responsibility of citizens and subjects of legal relations in order to prevent conscious and unconscious abuse of law; 2) preventive — that is, measures aimed at preventing or preventing situations in which a person formally acts within the law, but with an unconscionable purpose or intention to harm another party or avoid liability; 3) sanctioning — these are actions of the state or court aimed at suppressing cases of using law in an unlawful manner, even if the law is not formally violated (denial of legal protection, coverage of legal costs, imposition of a fine, disciplinary action, etc.).

 It is emphasized that the first step is to clearly establish whether this deformation has occurred, which involves analyzing the motives, purpose of the actions and real consequences for other participants in the legal relationship. If the actions are confirmed to be unfair, various methods can be applied, depending on the severity and at what stage the abuse was detected.
