The Genesis of the Institute of State Representation
The article examines the genesis of the institute of state representation in Ukraine, which in general has not been the subject of research in the field of general theoretical jurisprudence. It is noted that the concept or definition of the institute of state representation in the scientific community has not been studied, but only representation in its individual parts has been analyzed, namely in the part of administrative, civil, economic, criminal, international processes, etc. The author emphasizes that the growth of the role of representation in civil procedural law is due to constitutional guarantees of the implementation of citizens’ rights, as well as Ukraine’s obligations to international and European institutions regarding the implementation and protection of human rights. This, in turn, has necessitated the implementation of legal reforms in the state in the direction of improving the mechanisms for the implementation by citizens of the right to judicial protection from encroachments on life, health, honor, dignity, personal freedom and property, which is guaranteed by Art. 55 of the Constitution of Ukraine.
In the process of research, the author reveals the historical stages of the formation and development of the institution of representation, which corresponded to the existing social order, economic and political situation, which, in turn, were the main drivers of the development of legislation and the judicial system. The formation of the institution of representation is mainly associated with the legal regulation of the private sphere of public relations, the public-legal aspect (representation of the interests of the state) of regulatory regulation at the level of domestic legislation has not found detail. The continuity in the legal regulation of the institution of representation from Roman law, civil law to the modern realities of the representation of the interests of the state, by borrowing individual structures and rethinking (updating) the principles of representation in accordance with private and public interests in society, is obvious.
The researcher supports the position on understanding the institution of representation (including the state, as an independent subject of social relations) as a procedural activity of a person aimed at protecting the subjective rights and legally protected interests of another person participating in the case, state and public interests, as well as assisting the court in a comprehensive, complete and objective clarification of the circumstances of the case and making a lawful and reasoned decision.
The author does not ignore the genesis of the institution of representation of interests in the development of the national legal system (the times of Kyivan Rus, the Cossack state, the Hetmanate, the period when Ukrainian lands were part of the Kingdom of Poland and the Grand Duchy of Lithuania, the Russian Empire, the Soviet Union and independence). Therefore, the regulatory and legal regulation of the institution of representation is a complex multifaceted legal phenomenon that requires comprehensive research with the aim of its systematic improvement to increase the efficiency of the activities of the subjects of representation and protect the interests of the state.
