Implementation of law in modern technological realities: new opportunities and challenges

The article is devoted to the study of the impact of modern technologies, in particular information technologies, on the process of implementing law. The controversial impact of modern technologies on the practice of implementing legal norms, its positive and negative aspects, is emphasized.

It is noted that modern technologies contribute to a significant expansion of civic activism, freedom of expression, access to information, economic freedom, etc. We are talking about numerous opportunities for organizing public movements and actions, which open up new opportunities for influencing political and legal decisions in the state; about the development of the digital economy, remote work and freelancing, which allow people to choose previously unknown forms of employment and open their own business regardless of traditional restrictions; about free and anonymous access to almost any information and knowledge, which contributes to the development of critical thinking, broadening the worldview and forming a more conscious individual choice of the individual; about the development of social networks and digital communication platforms, which enable every person, including a child, to freely express their thoughts, views and beliefs regardless of geographical and social barriers, and also contribute to the realization of their creative potential.

At the same time, among the most general challenges of high-tech human civilization for the modern implementation of law, which requires a proper, adequate solution both at the national and international levels, in our opinion, two blocks of issues should be distinguished, namely:

  1. The problem of transforming the content of the fundamental values of law, as well as clear, coordinated regulatory mechanisms for their implementation in public and state life, in particular freedom, justice, equality, humanism, human rights, etc.
  2. The problem of finding optimal moral criteria for technological development and social communications in the conditions of the functioning of a technocratic society, the correct definition of which determines the quality of the implementation of law in the forms or methods established in the legislation, as well as the effectiveness of interaction between social regulators in the process of their regulatory and organizational influence on society and citizens.

As a result of research the following conclusions are made:

  1. The implementation of law in modern technological realities is a complex, multifaceted process that should not be limited to a purely formal or regulatory aspect of its manifestation, but must be based on the interaction and interconnection of law and other social, cultural, moral and technological factors, which requires the use of a comprehensive approach to assessing the effectiveness of relevant law implementation practices, as well as constant updating of existing legal structures and mechanisms for their practical implementation in public life.
  2. The revival and strengthening of traditional morality in a modern democratic society is the most important task in the conditions of technocratization of almost all spheres and branches of social life. After all, it is traditional morality that contributes to the formation of a responsible personality with a high level of legal awareness and culture, which, in turn, ensures the high-quality implementation of law in any form, and only a strong reliance on stable and time-tested moral guidelines can ensure the preservation of legal identity and internal integrity and voluntary consensus in society. The effective implementation of law in the conditions of modern technological development is impossible without a moral «compass», which will maintain the priority of a person over the corresponding technique and technology, since it is traditional moral principles and norms that provide the opportunity to establish clear boundaries of what is permissible in the legal regulation of any social processes, in particular technological ones, as well as to maintain the optimal balance between innovations and values of democratic legal development.​​
