Justice as a principle of Law-making in Martial Law
The article examines the theoretical and legal principles of justice in lawmaking under martial law, in particular in the context of the need to ensure a balance between state security and respect for human rights and freedoms. The emphasis is on the fact that lawmaking in times of crisis is not only a mechanism for responding to threats, but alsoa tool for preserving the democratic principles of the rule of law. It is emphasized that justice should remain one of the basic principles in lawmaking even in situations where it comes to temporary restrictions on certain rights. Legal acts adopted in wartime must meet not only the formal requirements of legality, but also moral legitimacy based on humanistic values.
A number of examples of the importance of the principle of legal certainty, which is a component of the principle of justice, ensuring the predictability of legal consequences for subjects of legal relations, are considered. The role and significance of international humanitarian law, the provisions of the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms in the formation of standards of lawmaking in armed conflict are analyzed.
