Genesis of scientific and legal support for spatial planning in the field of construction

 The article is devoted to the historiography of research on construction law, its system, individual legal institutions and categories, in particular, spatial planning. It is noted that a number of doctrinal studies are devoted to the issues of administrative and legal regulation of relations in the field of construction. The historiography of scientific research on administrative and legal regulation of spatial planning can be characterized as a study of the works of historians-researchers of construction law. Scientists analyze the influence of the norms and provisions of administrative law in the regulation of spatial planning relations, propose elements of the system of public private law, explore the conceptual apparatus and carry out a sectoral conceptualization of construction law, note the dual nature of construction law, one part of which regulates issues of spatial planning, and the other part - issues related to individual construction projects. Some scientists define the term spatial planning as the purposeful activity of subjects of spatial planning activity regarding the balanced, rational use of land, taking into account public and private interests. The study of 4 major historical periods of spatial planning of the city of Kyiv is considered. The conclusion is made about the absence of systematic theoretical developments in the educational and scientific legal literature that would be devoted to the institution of spatial planning, which is due to the lack of connection between the science of public construction law and the practice of administrative and legal regulation of spatial planning.
