Human and citizen rights and constitutional obligations in the conditions of martial state in Ukraine: current challenges and european guidelines

The article examines the constitutional foundations of the legal status of the individual and the citizen in Ukraine under martial law, with a focus on the permissible limits of restricting rights and freedoms and on the role of constitutional duties. The analysis proceeds from the priority of human dignity and security as core constitutional values, as well as from the principle prohibiting the narrowing of the substance and scope of existing rights in law-making and law-enforcement. The paper explores the constitutional model of rights restrictions during martial law through the requirements of legitimate aim, temporality, legal certainty, and proportionality, and substantiates the practical significance of duties as an element of the constitutional balance between rights and responsibility in conditions of heightened security risks. Special attention is paid to European benchmarks for the protection of human rights under exceptional legal regimes and to the alignment of national instruments with these standards. The article argues that the sustainability of the martial-law framework depends not only on administrative speed but primarily on constitutional guarantees, predictability of restrictions, and effective legal remedies.
