Conceptual problems of municipal law implementation in the context of contemporary transformations

In the process of establishing and modernising local self-government, it is particularly important to study the role, essence, content, main directions and forms of the regulatory influence of municipal law on social relations in the sphere of organisation and functioning of municipal authorities and protection of municipal human rights.

The article analyses methodological and praxeological factors that determine the transformation processes in the implementation of municipal law under martial law. In this context, attention is drawn to trends in the development of municipal law in the context of the challenges posed by the Russian-Ukrainian war. First of all, controversial issues of the implementation of the right to peace in the context of the development of municipalism and municipal law are raised. The content of the concept of «municipal peacebuilding» and its characteristics are revealed. In this regard, the main factors determining the processes of implementing the right to peace in territorial hromadas are examined. The dialectical relationship between the processes of municipalism formation in modern Ukraine and the state of implementation of the right to peace from the point of view of the formation of the legal personality of the territorial hromadas is demonstrated.

In the context of the challenges of implementing municipal law in today’s environment, the synergistic relationship between phenomena such as «municipal peacebuilding» and «military municipalism» is revealed. It is argued that the importance of studying the problems of territorial territorial hromadas participation in the implementation of the right to peace is determined by the needs of local self-government development in general, as well as by the need to develop methodological approaches to a value-based understanding of contemporary municipalism and peacebuilding.

It is argued that the implementation of municipal law in modern territorial hromadas is becoming complex and multidimensional, going beyond traditional regulatory frameworks. It encompasses ensuring the safety of the population, social integration, supporting the sustainability of territorial hromadas, sustainable local development, socio-economic and spiritual-cultural renewal, as well as restoring trust as a key condition for the functioning of municipalism.

In the context of the real functioning of civil society and the deepening of decentralisation processes, municipal law emerges not only as a set of norms and principles, but as a living legal practice of local democracy. It materialises in the daily activities of territorial hromadas aimed at protecting human dignity and ensuring freedom, security and the sustainability of social coexistence.
