Modern legislative trends in the field of protection of veterans’ rights and freedoms: conceptual update, problems of regulation and implementation
The article is devoted to the generalization of legislative trends in the field of protection of the rights and freedoms of veterans in the modern period. Their study demonstrates the long process of creating a system of national legislation from the 90s of the twentieth century. to the present, the accumulation of laws and by-laws relating to the social and legal protection of military personnel and their family members; on the status of war veterans, guarantees of their social protection; on social services; on the rehabilitation of persons with disabilities in Ukraine; on rehabilitation in the field of health care; on veteran entrepreneurship, etc. An important group among by-laws is made up of strategic and program documents, for example, the Strategy of Veteran Policy for the Period Until 2030, the Strategy for the Formation of a System of Return from Military Service to Civilian Life for the Period Until 2033, etc. The legislation of Ukraine provides for over 40 types of benefits for war veterans, provided by various bodies and institutions, significant conflicts and duplication of norms on social benefits for war veterans, family members of deceased war veterans and families of deceased Defenders/Defenders provide for monitoring of the regulatory provisions of about a dozen laws and almost two hundred by-laws. This actually complicates or even makes impossible the proper implementation of the aforementioned benefits, guarantees etc.
The emphasis is on the activation of legislative initiatives, including codified acts, such as: drafts of the Code of Ukraine on the Protection of Statehood, Independence and the Status of Defenders of the State, the Code of Ukraine on State Veteran Policy; the Veteran Code of Ukraine etc. The effectiveness of regulatory legal acts is ensured, first of all, by their accessibility, scientific validity, stability, efficiency etc. That is, the aforementioned draft laws require significant revision, including taking into account positive foreign similar practices of legislative regulation and law enforcement. Successful foreign practices in the protection of the rights and freedoms of veterans, veteran policy (USA, Israel, South Korea, Australia, Croatia, Serbia).
Ultimately, the state of legislative support for the rights and freedoms of veterans, veterans’ policy in Ukraine, generalization of lawmaking trends in this direction requires the development and promotion of international law-making initiatives, the development of standards and principles of veterans’ policy, state and international support for veterans/veterans. The accumulated Ukrainian and foreign experience will contribute to standardization, determination of the minimum framework for protecting the rights and freedoms of veterans, their reintegration and socialization, expansion of the system of protection guarantees, implementation mechanisms, and law enforcement practice in this area.
