Main trends in the development of constitutional law science in modern Ukraine: doctrinal analysis

The article is devoted to the definition and scientific analysis of the main trends in the development of modern constitutional law science in Ukraine in the context of political, legal, social and institutional transformations caused by the processes of democratization, European integration and the challenges associated with the functioning of the state in war conditions. It is substantiated that modern constitutional law science is gradually transforming from a predominantly normative-dogmatic approach to a complex doctrinal understanding of constitutional and legal phenomena through the prism of value-based, human-centered and institutional paradigms.

It is proven that the constitutional and legal doctrine plays a key role in the formation of modern Ukrainian constitutionalism, the development of the rule of law, the establishment of European standards of constitutional democracy, the deepening of mechanisms for the protection of human rights and freedoms, as well as in ensuring the institutional efficiency of public authorities. Based on the generalization of modern scientific approaches, the main trends in the development of domestic science of constitutional law have been identified, among which the following are distinguished: the axiologization of constitutional law, which is manifested in increased attention to the study of the system of constitutional values as the fundamental basis for the functioning of the constitutional system; the humanization of constitutional law, associated with the establishment of a human-centric paradigm and the growth of scientific interest in the issues of ensuring and protecting human rights and freedoms;

Europeanization of constitutional law, which finds its expression in the study of the processes of harmonization of national constitutional legislation with European legal standards; praxeologization of constitutional law, which is characterized by an increase in the practical focus of constitutional and legal research and their orientation towards improving the mechanisms of functioning of public authorities; the development of the doctrine of constitutional regimes in emergency situations, driven by the need to understand the functioning of state bodies in times of crisis; as well as the digitalization of constitutional law, which reflects the formation of new scientific approaches to studying the impact of digital technologies on constitutional institutions and the development of the concept of digital constitutionalism.

A reasoned conclusion is made that the modern development of the science of constitutional law in Ukraine should be realistic and practice-oriented, aimed at the formation and improvement of domestic constitutional and legal practice, ensuring scientific substantiation of law-making and law-enforcement processes, as well as their compliance with modern social and political and legal challenges and strategic guidelines for the development of the Ukrainian state and society.
