Peculiarities of legislative regulation of agrarian relations in the EU and in EU member states: experience for Ukraine

The article conducts a comprehensive scientific analysis of the features of the legislative regulation of agrarian relations both at the EU level and in the EU member states, and substantiates the directions of transformation of the legislative regulation of agrarian relations in Ukraine after gaining EU membership.

It has been established that in order to ensure the approximation of the national agricultural policy to the EU Common Agricultural Policy in the process of developing agricultural legislation and its adaptation to the requirements of the acquis, it is important to adhere to the principles of building the main elements of the national strategic plans of the EU member states, the adoption of which is provided for by the Common Agricultural Policy for 2023–2027, in particular: ensuring a fair income for farmers, increasing their competitiveness; improving the position of farmers in the food chain and especially — action on climate change, caring for the environment, preserving landscapes and biodiversity. An important signal for the start of the process of approximation of Ukraine’s agricultural policy with the European principles of the Common Agricultural Policy is the approval of the Strategy for the Development of Agriculture and Rural Areas in Ukraine for the period until 2030 by the order of the Cabinet of Ministers of Ukraine dated November 15, 2024. Although the Strategy generally takes into account the EU’s national strategic plans within the framework of the new Common Agricultural Policy for the EU, it is not without certain legal defects that need to be eliminated.

From the moment of accession to the EU, agrarian legal relations in Ukraine will be regulated by regulatory acts of three levels: 1) international agreements in the field of agriculture, sustainable development, climate protection and biodiversity, development of rural areas, export and import of agricultural products, regulation of labor in agriculture; 2) the EU Common Agricultural Policy and the EU acquis in the field of agricultural production and development of rural areas; 3) the national strategic plan for the development of the EU Common Agricultural Policy, the Constitution of Ukraine, laws and subordinate regulatory legal acts aimed at regulating agrarian relations, decisions of the European Court of Human Rights, the Constitutional Court of Ukraine, and court precedents. At the same time, international legal acts and EU regulations will have higher legal force than the regulations of the agrarian legislation of Ukraine.
