Institutional coordination of state authority in the field of human rights protection

The article reveals that effective protection of human rights in a democratic society requires not only the declarative recognition of rights and freedoms, but also coordinated, institutionally supported interaction between all branches of government. This is especially important in the context of security challenges that alter the nature of state intervention in both public and private spheres. It is established that the harmonization of the functions of the judiciary, legislature, and executive, as well as the implementation of mechanisms of parliamentary control, the activities of the Ombudsman, and the enforcement of the European Court of Human Rights’ rulings are critically important for upholding legal standards.

The study analyzes how state institutions exercise their powers in the field of human rights, what the boundaries of their interaction should be, and how to ensure accountability and transparency. The focus lies not only on the distribution of powers between the branches of government, but also on the quality of their interaction within the framework of human rights standards. It is generalized that the key conditions for effective institutional coordination in the field of human rights protection are adherence to the principles of the rule of law, subsidiarity, transparency, and checks and balances. The coherent application of these principles creates an institutional environment in which human rights are not sacrificed for political expediency but remain a constant guideline for state decision-making.

The analysis of the institutional interaction of state authorities in the field of human rights protection gives grounds to assert that in a democratic system, only a comprehensive and coordinated system of public administration is able to ensure the proper level of observance of citizens’ rights and freedoms. Such a system provides not only for a clear delimitation of the functions of the Verkhovna Rada, the Cabinet of Ministers, the Constitutional Court of Ukraine and the Ombudsman, but also for the effective functioning of control, feedback and public accountability mechanisms.

The constitutional principle of «checks and balances» is not only a political and legal declaration, but also a practical tool for preventing abuse of power in the context of human rights restrictions. Its implementation requires updating the procedures of parliamentary control, strengthening the role of the Constitutional Court of Ukraine as a guarantor of legal arbitration and expanding the powers of the Ombudsman as an independent subject of human rights protection.

Effective coordination of actions of all branches of government becomes particularly relevant during a state of emergency or martial law, when the risk of narrowing rights under the pretext of security is most tangible. It is at these moments that the state must demonstrate its ability to act within the framework of constitutional principles and international obligations, without losing its humanistic orientation. The model of institutional coordination in the field of human rights in Ukraine requires further transformation: from a hierarchical model of the vertical of power to a network system of interaction, where each subject, including civil society, has an influence on the decision-making process. The key conditions for the successful implementation of such a model are: the rule of law, openness, subsidiarity and controllability.
