The mechanism of the state in ensuring the implementation of the norms of law in wartime: legal and institutional aspects

The article is devoted to the legal and institutional aspects of the state mechanism in ensuring the implementation of the rules of law during war. The study of such aspects allows us to clearly determine what exactly constitutes the normative basis for the functioning of the law and order, and what is the mechanism for its practical implementation. In this context, legal aspects encompass a system of regulatory provisions, principles and procedures that define the limits of permissible state intervention in the sphere of rights and freedoms, establish rules of conduct for subjects and establish guarantees of their observance even under extraordinary challenges. In turn, institutional aspects reflect the organizational, structural and functional characteristics of the activities of state authorities, their ability to ensure the proper application of law, coordination of actions, control and responsibility in the process of implementing regulatory and legal provisions. The legal aspect forms the substantive guidelines and boundaries of the state’s activities through constitutional principles, special legislation, derogation procedures and human rights guarantees.

The legal aspects of implementing legal norms in wartime include norms, principles, and legal mechanisms that determine the grounds and procedure for introducing martial law, the scope and limits of restrictions on human rights, and the powers of state authorities. Instead, the institutional aspect ensures the practical implementation of these provisions through the functioning of state authorities, the judicial system, law enforcement agencies, the system of free legal aid, as well as through interaction with civil society institutions. First of all, this is the functioning of state authorities, in particular the activities of parliament in wartime, the concentration of executive powers, the creation of military administrations, and the adaptation of the judicial system.

The emphasis is on the implementation of legal norms by the state itself, which is a prerequisite for the formation of proper legal behavior of citizens, since the state is the main carrier of public power and the source of legitimacy of the legal order. It is emphasized that in wartime, the legal awareness of the population is transformed from an optional factor of legal development into a system-forming element of the mechanism for ensuring the implementation of legal norms.
