Compliance with the law: transformation of the concept and content in a digital society

The article emphasises that an important feature of compliance with the law is its voluntary nature, determined by the level of legal awareness and legal culture of the individual, rather than external coercion. However, the digitalisation of social relations is significantly transforming the traditional mechanisms for implementing the law. It is noted that the problem of the content of law enforcement arises due to the fact that, in the context of digitalisation, the phenomenon of formal or automated law enforcement arises, in which lawful behaviour is ensured not so much by the level of legal awareness as by algorithms embedded in digital systems.

The main features of a digital society are identified: 1) the digital format of social relations and new digital technologies; 2) digital socialisation and communication; 3) new principles, values and, in general, the mechanism of legal regulation, transformed in the context of digitalisation.

In a digital society, the meaning of compliance with the law is significantly transformed in view of the following: firstly, compliance with the law takes on a mixed character, combining passive and active lawful behaviour; secondly, the focus is shifting from the internal expression of will and legal awareness of the subject of law to technological digital mechanisms, where the behaviour of the subject is restricted or directed by technical means regardless of their will.

It is concluded that, in a digital society, compliance with the law takes on a complex character and encompasses not only legal but also technological and informational dimensions. In view of this, we understand compliance with the law in a digital society to be a form of law enforcement that represents a transformed and technologically mediated model of lawful behaviour by subjects, consisting of refraining from the unlawful use of digital technologies, information resources, etc., as well as a conscious and responsible attitude towards digital rights, restrictions and corresponding obligations, which contributes to ensuring a balance of digital rights, freedoms and legitimate interests of participants in social relations.
