Active and passive law of the Embassy of the Principality of Andorra

The article examines theoretical and practical issues of the active and passive law of the Embassy of the Principality of Andorra as one of the aspects of its international legal personality. It is shown that with the adoption of the Constitution of Andorra in 1993, the international position of the Principality changed, it became formally independent, capable of entering into international relations with other subjects of international law, establishing diplomatic relations with them and exchanging embassies.

It is concluded that at the current stage of its statehood, the Principality of Andorra, as a full member of the international community, which possesses international rights and obligations, has its own peculiarities in the implementation of the active and passive right of the embassy. This is manifested in the fact that the Principality of Andorra exercises its active and passive embassy rights (in accordance with the norms of the Vienna Convention on Diplomatic Relations of 1961 and the Tripartite Treaty between the Principality of Andorra and the French Republic and the Kingdom of Spain on good-neighborliness, friendship and cooperation of June 3, 1993) both independently and through the relevant diplomatic missions of France and Spain on the basis of a special agreement with the named countries.
