Implementation of law in the legal systems of the European Union: modern approaches and practical dimensions
The article is devoted to a comprehensive analysis of modern approaches to the implementation of law in the legal systems of the European Union, taking into account the transformation of law enforcement practice in the conditions of a multi-level legal order. It is noted that the practice of the European Union and its institutions significantly influences the formation of unified standards for the implementation of legal norms, in particular in the field of their implementation, application and compliance. One of the key approaches is the principle of the rule of law of the EU, according to which the norms of the Union have priority over the domestic legislation of the member states, which ensures the unity of the legal space and the uniformity of the application of legal provisions in different countries. Another important modern direction is the principle of direct effect of EU law, which allows individual norms to be directly applied in national courts and administrative practice. This strengthens the role of judicial institutions in the process of implementing law, since it is the courts that become the guarantor of the effective implementation of European legal standards It is substantiated that the implementation of law in the EU is increasingly oriented towards a human-centric model, within which the priority is to ensure effective protection of individual rights and freedoms, access to justice, equality and non-discrimination. The practice of the Court of Justice of the EU is analyzed as a tool for specifying the content of rights and freedoms, forming general principles of Union law and ensuring their uniform application in the Member States.
Separately, the digitalization of legal processes is analyzed as a modern tool for increasing the accessibility, transparency and efficiency of the implementation of rights in the EU, in particular in the context of the functioning of e-justice and the use of digital legal mechanisms. It is concluded that approaches to the implementation of law in the legal systems of the European Union are characterized by a combination of supranational regulation and national law enforcement practice, the priority of human rights, the harmonization of legislation and the introduction of innovative mechanisms to ensure the effective functioning of the EU legal order.
