Protection of human rights in conditions of martial law: law-making and law-implementing features of provision
Ensuring the legal regime of martial law requires coordinated activity of all levels of government within the legal field (national and international), it should define a functional mechanism that allows the state, even in wartime conditions, to fulfill the constitutional duty to protect human rights, preserving law and order and observing democratic international standards.
It is the duty of the Parliament to ensure the legal basis for regulating social relations through extraordinary law-making; executive agencies should ensure the practical implementation of the legal regime by implementing measures of security, humanitarian protection, social support and access to justice; the judiciary plays a key role in preventing abuses by monitoring compliance with the principle of proportionality of human rights restrictions and providing effective means of their legal protection; local self-government bodies are designed to guarantee the availability of basic services, timely information, response to the needs of communities and the organization of civil protection, etc.
Transformations and redistribution of emphasis in the law enforcement activities of state authorities can have both positive effects and negative consequences, among them are the unreasonableness and disproportionality of human rights restrictions, the excess of centralization of powers and the risk of their abuse, the militarization of public administration, limited access to justice, the difficulty of controlling the activities of military administrations and the risks of exceeding the powers granted to them.
Thus, the state’s activities to protect human rights under martial law are a complex, multidimensional process that combines the functions of security and legal protection and must comply with the principle of balance between national security interests and basic human rights. Its effectiveness is determined by the State’s ability to provide real, rather than declarative, protection of human rights, while respecting the principles of legality, proportionality and the rule of law. Overcoming these challenges is possible by strengthening internal mechanisms of responsibility, judicial and parliamentary control, control of international institutions, increasing the effectiveness of law enforcement agencies and the ombudsman institution, developing legal culture and increasing the professional responsibility of officials. The difficulty of realizing this goal requires the use of special methods of public administration, the search for new optimal combinations of their combination and implementation.
