The mechanism for implementing legal norms, the mechanism for using legal norms: an essential characteristic in the context of martial law

The need to find new scientific approaches to solving the problem of the mechanism for implementing legal norms, its correlation with the mechanism for using legal norms from the point of view of its conceptualization and taking into account the peculiarities of the legal regime of martial law is emphasized.

The concept of the mechanism for implementing legal norms is defined, which should be understood as forms, methods, and means used to ensure compliance, implementation, or use of legal norms in various spheres of public life.

Emphasis is placed on the peculiarities of the mechanism for implementing legal norms, namely: a certain type of behavior or activity (inaction) of subjects; a set of legal means that are instrumental in nature, structurally unified and logically consistent, and perform certain tasks and functions in order to achieve the desired result, etc.

The mechanism of using legal norms is defined as a set of normative, institutional and procedural elements (means) by means of which legal subjects exercise the subjective rights granted to them through active (passive) behavior.

It is emphasized that during the period of martial law, the specified mechanism does not lose its substantive content, but is modified to some extent, taking into account certain temporary restrictions on the scope, methods and means of implementing the authorizing norms.
