Protection of the right to social security under martial law in Ukraine

The article is devoted to the study of the protection of the right to social security under martial law. It emphasizes the systemic problem of the lack of effective mechanisms for the extrajudicial protection of social rights, the overload of administrative courts, and the problem of non-enforcement of court decisions.

The study examines international legal standards for the protection of the right to social security, which enshrine the accessibility, affordability, timeliness, and effectiveness of remedies in the field of social security. The significance of the Convention for the Protection of Human Rights and Fundamental Freedoms and the case law of the European Court of Human Rights in protecting the right to social security is characterized.

Particular attention is paid to the problem of the lack of alternatives to judicial protection of the right to social security and the absence of effective extrajudicial procedures. The issue of non-enforcement of court decisions in social disputes is analyzed. The role of social dialogue in ensuring a comprehensive state social policy and in resolving social disputes through extrajudicial procedures is highlighted.

It is emphasized that the expansion of private-law principles in the legal regulation of the right to social security, the development of social services, and the decentralization of social security bring to the fore the need to develop alternative dispute resolution procedures in this field, in particular mediation.

Conclusions are drawn and specific recommendations are provided for improving the protection of the right to social security under martial law.
