The impact of martial law on the deformation of professional legal awareness of court employees
The article presents the results of theoretical research and analysis of the formation of legal consciousness of court employees, the deformation of legal consciousness, because the stability of the functioning of the judicial system in general, and in conditions of martial law, the ability of society to overcome these processes depends on the understanding and controllability of these processes.
In particular, its elements are identified as: the manifestation of legal consciousness in individual, group and social relationships of subjects of law, consideration of legal consciousness depending on the level (depth of knowledge of legal phenomena): everyday; practical; scientific. Deformation of legal consciousness as a phenomenon.
It has been established that the main deformations of court employees are: underestimation of the law, legal disappointment, violation of current legislation by the judges themselves, use of official position for useful purposes, atrophy of moral consciousness, legal nihilism, degeneration into a criminal form, etc.
This is explained by both objective and subjective reasons, in particular: the lack of formation of the national legal system; political, economic and social instability, imbalance of power institutions, inefficiency of the judicial system, combined with the crisis of law enforcement agencies, ineffective use of the education system, lawlessness, corruption, rudeness, immorality, injustice, the presence of phenomena of legal nihilism among court employees, etc.
An additional negative factor that influenced the deformation of court employees is the burden of war, the constant pressure of danger that affects everyone without exception.
The study used real manifestations of deformation of the legal consciousness among court employees. It is characteristic that no matter what position you hold, secretary of the court session, judge, chairman of the Supreme Court, everyone can face deformation of the legal consciousness.
Ways of further research and overcoming negative consequences for society are identified.
