Interaction with state authorities in the law-making process: current state, problems and areas for improvement
The article examines interaction with public authorities in the law-making process as a complex phenomenon that extends beyond formalized procedures and encompasses both institutional and informal communication mechanisms. It is substantiated that such interaction is implemented through the representation of interests of various socio-economic groups, including the parties to social dialogue, business associations, civil society organizations, and the expert community.
The current state of the law-making process in Ukraine is analyzed, with particular attention to practical forms of interaction between public authorities and stakeholders. It is established that, alongside formal mechanisms (working groups, consultations, expert discussions), informal communication practices play a significant role in shaping shared understanding and aligning positions.
Key problems affecting the quality of legal acts are identified, including the excessive focus on legal technique without adequate consideration of practical processes, the complexity and ambiguity of legal norms, and insufficient interagency coordination.
The article proposes directions for improving the law-making process, including the development of interdisciplinary competencies of lawyers, strengthening the role of communication as a system-forming element of law-making, the introduction of a process-oriented approach, and the institutionalization of interaction with public authorities. It is further argued that such interaction should be considered as an instrument of horizontal coordination of public policy.
The scientific novelty lies in substantiating a communication-oriented model of the law-making process which, unlike classical social dialogue, encompasses a wider range of actors, integrates both formal and informal mechanisms, and defines communication as the primary stage in the formation of legal norms.
